Understanding the Eviction Process in Massachusetts

Eviction can be stressful for both landlords and tenants in Massachusetts. Knowing the typical timeline can help you prepare and understand what to expect. In general, the eviction process in Massachusetts takes between 2–4 months, but the timeline can vary based on the type of eviction, whether the tenant contests the case, and court availability.

Step 1: Notice to Quit (14–30 Days)

The process begins when the landlord serves a Notice to Quit.

  • Nonpayment of Rent: 14-day notice
  • Lease Violation: Usually 30-day notice
  • No-Fault/End of Lease: Typically 30-day notice

If the tenant does not move out by the deadline, the landlord can move forward with a formal eviction.

Step 2: Filing the Summary Process (7–30 Days)

If the tenant remains, the landlord files a Summary Process Summons and Complaint in Housing Court or District Court.

  • Trial is usually scheduled 7–30 days after service.

Step 3: Court Hearing & Judgment (1–2 Weeks)

At the hearing, the judge decides whether the landlord has the right to evict.

  • If the tenant doesn’t appear, the landlord may win by default.
  • If the tenant contests, the process can stretch longer.


Step 4: Execution for Possession (14 Days)

If the landlord wins, the court issues an Execution for Possession after 10 business days. The landlord must then work with a constable or sheriff to schedule the actual eviction. This usually takes another 1–2 weeks.

  • Best case (uncontested): ~2 months
  • Contested cases: 3–4 months or longer
  • Delays: Appeals, tenant protections, or court backlogs can extend the process.
